Subject: Counter Proposal
- ARTICLE 4 - ASSIGNMENTS
- The District prefers the current language for 4.1 which requires instructional
administrators to first consider all part-time instructors who have taught
a course for Mendocino College for the same course the next time it is
offered, regardless of location, before a new part-time instructor is hired.

- ARTICLE 13 - EVALUATIONS
-
- 13.2 and Exhibits B, C, and D as included in 11/5/98 District proposal
are acceptable to MPFA.

- 13.3 as proposed by MPFA on 11/5/98 is not acceptable to the District.
The timing of evaluations are set forth by the Ed Code, as included in
13.1 - once during the first semester of employment and a minimum of once
each six semesters thereafter.

- More frequent evaluations are a management prerogative, consistent
with all evaluation processes of the District. Because 13.1 allows the
District to conduct more frequent evaluations when needed, a follow up
evaluation can be conducted during the following teaching assignment,
as determined by the instructional administrator. This is already part
of the evaluation process. (See Exhibit B, Evaluation Process for Part-time
Instructors; Form A, Evaluation Summary, Recommendations - "Re-evaluate
during next Mendocino College teaching assignment".)

- ARTICLE 16 - SALARY
-
- The District does not agree to language proposed by MPFA for 16.6,
"continuing adjunct employee".

- (Revised) 16.9 Office Hours:
- The District will establish a $27,000 pool for office hours (50% to
be reimbursed by the state), according to the attached proposal, for the
Fall 1999 and Spring 2000 semesters.

- (Revised) 16.10 Effective Fall Semester, 1998, the part-time faculty
salary schedule will be increased by 6.00% as follows:

- - a 2.26% COLA
- - a 3.74% Equity Increase
- 6.00%

- Alternatively, the District is willing to consider adding a total
of 7% to the salary schedule with no compensation for office hours.

- Individual employment contracts will state: Compensation for services
rendered under this contract for semester-length assignments will be made
as follows: Fall Semester (8% on 9/10 and 23% on 10/10, 11/10, 12/10 and
1/10) and Spring Semester (8% on 2/10, and 23% on 3/10, 4/10, 5/10 and
6/10). Short-term and Summer Session assignments will also be compensated
in equal monthly payments according to the length of the assignment. Compensation
for flex activity tie will be paid upon fulfillment of the Flexible Calendar
Activities Agreement and receipt of the appropriate paperwork.

- ARTICLE 17 - EMPLOYEE BENEFITS

- ARTICLE 21 - DURATION

- (Revision) 21.1 This Agreement shall be in effect from July 1, 1998,
through June 30, 2001.

- (Revision) 21.2 Each party reserves the right to reopen negotiations
for 1999-00 and 2000-01 under Article 16, (Salary);

- Article 20, (Duration); and an additional three (3) articles each.

- 16.9 Office Hours (Proposal)

- a. While not required to have schedule office hours, part-time instructors
are expected to be available for consultation with students.

- b. In an effort to contribute to the success of students, Mendocino
College will provide a pilot program for a limited number of paid office
hours for part-time faculty during the Fall 1999 and Spring 2000 semesters.

- c. To be eligible for consideration, a part-time instructor must teach
at least 40% FTE in the semester being considered.

- d. One office hour per week for each week included the part-time instructor's
contract is potentially available to those who choose to apply for office
hours. by completing the "Application for Part-Time Instructor Office
Hours" form sent with the contract and returned prior to the first
day of instruction. Office hours will be paid at $20/hour and approved
on a first-come, first-served basis, up to the total funds available.
